Description

Considers the impact of the COVID pandemic on contracts and their execution under English law and the impact, if any, the doctrine of frustration had in alleviating the pandemic's impact on parties and whether force majeure clauses if available could provide the answer. Concludes that early communication between and proactive problem solving by the parties and the use, where necessary, of alternative consensual forms of dispute resolution were the more reliable and effective ways to minimise negative impact.
