A comparative overview of the concept of the freight forwarder

Abstract

The freight forwarder is a profession, which has many guises. In has developed historically from its origins, comprising the organisation of transport on behalf of a principal, with or without additional provision of services for border clearances and documentation. This may still be the core business for some freight forwarders nowadays, yet others offer all-in multimodal transport and logistics operations services. Adding to the difficulty in determining the exact service that was agreed under such a wide business concept is that different legal systems categorise the freight forwarding business differently, thus emphasising different roles and resulting duties.

This paper provides an overview over these different legal categorisations of the freight forwarder and his business activities. While most systems give consideration to the manner in which the freight forwarder presents his services and performs his duties including the documents he uses, the initial categorisation and starting point from which this analysis is conducted is significant. Irrespective of the legal system, the freight forwarder can drive legal certainty by carefully matching the documents to the service arrangements made.
