Abstract

This chapter investigates whether it is possible to write the history of a rule of law in the context of the development of the ius commune in Western Europe in the period 1100-1900. It examines the pitfalls associated with such genealogies and argues that more emphasis needs to be placed on dogmatic history as a form of historical enquiry.
