Abstract
Asks whether the enactment of the Legal Writings (Counterparts and Delivery) (Scotland) Act 2015 was necessary, or whether execution in counterpart was always possible under Scots law. Examines the perceived problem with the Requirements of Writing (Scotland) Act 1995 and the reasons why the Scottish legal profession welcomed the 2015 Act. Considers the effects of the 2015 Act regarding delivery.
