Abstract / Description of output
The statutory pledge introduced by the Moveable Transactions (Scotland) Act 2023 will not be able to cover shares in companies. Discussions are ongoing with the UK Government to include shares. This article outlines the need for shares to fall within the regime, focusing on a recent case that demonstrates conceptual risks with improper security.
