Abstract
The tacit hypothec in urban tenancy, a Roman-law rule with widespread application in modern civilian systems, has often been criticised for being an inadequate for of security. This paper examines the scope and function of this rule and argues that its reception into the ius commune may have overlooked a vital aspect of the working of the rule.
