Towards the Medieval Law of Hypothec

Abstract

This chapter investigates the medieval treatment of a rule of law for which there appears to be no justification in the Justinianic compilation of Roman law. By examining medieval justifications for this rule of law it demonstrates a variety of techniques used by the jurists to create general rules of law.
