Abstract

Discusses the appointment of administrators under the Insolvency Act 1986 Sch.B1, as introduced by the Enterprise Act 2002, and considers the issue created where more than one creditor is a floating charge holder over the assets of a debtor company. Examines the rules governing the ranking of floating charges under the Companies Act 1985 s.464. Highlights the impact of the Scottish specific provision under Sch.B1 para.15 of the 1986 Act.
