The Scots law equivalent of a “transaction at an undervalue” is a “gratuitous alienation”. In a December 2019 judgment, the Supreme Court provided much needed clarity on both “adequate consideration” needed to avoid a transaction being a gratuitous alienation and potential remedies available to the court.
